Nicotine Vending Machines in Nevada: What the Rules Say
Nevada is not open for every kind of nicotine vending, and we would rather say so than take an application we cannot finish.
Afterwrk is not placing machines in Nevada yet. Nevada's Department of Taxation says a vending machine for other tobacco products is not permissible under the state's current licensing framework. Until there is a lawful route for what a machine would sell, we take interest from Nevada venues and nothing more.
Under regulatory review — not placing Nevada: Cigarette vending has its own licence class; other tobacco products, which by statute include vapes and nicotine pouches, have none. Interest is welcome; placements are not.
What Nevada's regulator says
Nevada draws a line between cigarettes and everything else. A cigarette vending machine has a licence class of its own — NRS 370.015 defines a cigarette vending machine operator as a retail dealer licensed to sell only Nevada stamped cigarettes by coin-operated machine — and NRS 202.2494(1) makes such a machine lawful in a public area only where people under 21 are barred from loitering under NRS 202.030 or NRS 463.350. There is no equivalent licence for other tobacco products, and the Department of Taxation states that operating an OTP vending machine “is not permissible under Nevada law when the activity is not specifically authorized by the Legislature”. In plain terms: Nevada treats tobacco as an industry where an activity has to be specifically authorized before a business may do it. Cigarette vending has a licence. Vending of other tobacco products does not.
Which category a nicotine product falls into
This one is answered by statute rather than left open. NRS 370.440(2) defines an other tobacco product as “any tobacco of any description, any vapor product, any alternative nicotine product or any product made or derived from tobacco, other than cigarettes”. Vapes and nicotine pouches are each separately defined as well — NRS 370.054 and NRS 370.008 — but both are swept into that one OTP definition. So in Nevada the category question has a short answer: if it is not a cigarette, it is an other tobacco product, and the OTP position above applies to it.

The federal test still applies
Separately from state licensing, federal rules only allow tobacco-product vending in a facility where people under 21 are not present or permitted to enter at any time. A venue has to clear both. How the rules fit together →
Gaming properties

Is Afterwrk placing machines in Nevada now?
Not yet. Nevada has a licence class for cigarette vending and none for other tobacco products, and the Department of Taxation’s position is that an OTP vending machine is not permissible while the Legislature has not authorised it. We will not place a machine until there is a clear, lawful licensing route for what it would sell.
Is a cigarette vending machine different?
Yes, and it is the only category that is. NRS 370.015 defines a cigarette vending machine operator as licensed to sell only Nevada stamped cigarettes by coin-operated machine, and NRS 202.2494(1) allows such a machine in a public area only where under-21s are barred from loitering. The Department is explicit that this licence does not extend to other tobacco products, and NRS 202.2494(2) separately bars a machine containing cigarettes from dispensing anything not made or derived from tobacco.
Does a gaming floor being 21+ mean a casino qualifies?
Not by itself, and an age restriction does not create permission. NRS 202.2494(1) makes an age-controlled area a placement condition for a cigarette machine; it is not authority to vend anything else there. Separately, the federal restriction concerns the facility and who may enter it, so the specific area has to be assessed along with property policy and the gaming authority's position.
