Tobacco Products Ordinance — vending machines (ROA 1994 § 9-11-1-6)
City code read directly, edition 2026 S-95. Section 9-11-1-6(C) permits tobacco vending machines only where the machine is in an area not open to the general public; in places persons under 18 may not access without a parent or guardian; AND in places where alcohol is sold for on-premises consumption. The conditions are joined by 'and'. The city's stated age is still 18 and has not been updated to 21; federal and state law set 21 regardless. No tobacco-specific municipal retailer licence was located in Chapter 9 Article 11 or in the Chapter 13 article list.

21 CFR 1140.14(b)(3) — vending of covered tobacco products
eCFR text, 2026-09-17 issue. 1140.16(c) reaches cigarettes and smokeless tobacco only; the vending restriction for covered tobacco products — e-cigarettes, ENDS, cigars and nicotine pouches — is 1140.14(b)(3), with the same test: no vending except in facilities where the retailer ensures no person younger than 21 is present, or permitted to enter, at any time. Pouches are covered whether the nicotine is tobacco-derived or synthetic (21 CFR 1100.2, as amended 88 FR 16552).

21 CFR 1140.3 — definition of 'retailer'
A retailer means any person who sells tobacco products to individuals for personal consumption, or who operates a facility where vending machines or self-service displays are permitted under this part. A venue hosting a machine it does not own therefore meets the federal definition in its own right, and the duty to ensure nobody under 21 is present or permitted to enter is the venue's own.

NMSA 1978 § 61-37-2(N) — 'minor' means under 21
'Minor' means an individual who is younger than twenty-one years of age. This is why the state vending rule in 61-37-15(B) is a 21 rule and not an 18 one. Section 61-37-2(S) defines one umbrella term 'tobacco product' covering anything made or derived from tobacco or nicotine, expressly including e-cigarettes and electronic nicotine delivery systems; New Mexico defines no separate 'vapor product' or 'alternative nicotine product' category.

Retailer licence: issuing agency, term and fee
NMSA 61-37-7(A) requires a retailer licence issued by the division for each location; 'division' is the Alcoholic Beverage Control Division of the Regulation and Licensing Department, not the Taxation and Revenue Department, which licenses cigarette distributors and manufacturers instead. Term one year (61-37-4(B)(3)); NMAC 15.8.3.16(C) sets $750 on application and $400 on renewal per licensed location. No vending-machine licence, permit or per-machine fee was located in the Act or in NMAC Title 15 Chapter 8. NMAC 15.8.4.8 restricts who may sell and who may directly profit at a licensed location.

NRS 202.2494 — cigarette vending machines; restrictions on coin-operated machines
Read verbatim from the Legislature's own compilation, stamped Rev. 4/15/2026. Subsection 1: a cigarette vending machine may be placed in a public area only if under-21s are barred from loitering there under NRS 202.030 or 463.350. Subsection 2: a coin-operated machine containing cigarettes must not dispense any product not made or derived from tobacco, which catches vapes and nicotine pouches by statute. The Department FAQ never cites this section.

NRS 370.440(2) — definition of other tobacco product
Read verbatim. An other tobacco product means any tobacco of any description, any vapor product, any alternative nicotine product or any product made or derived from tobacco, other than cigarettes. This settles the product-category question: if it is not a cigarette it is an OTP. NRS 370.015 confines the vending operator licence to only Nevada stamped cigarettes; NRS 370.521(1) sets one minimum age of 21 across all of these categories.

Allows tobacco products to be sold from a vending machine only in a bar, or in a non-public employee lounge of a business that employs no minors. Requires an eighty-square-inch warning sign on the machine, and lets counties, cities and towns restrict locations further.
