Nicotine Vending Machines in Las Vegas: What Venues Need to Know
The short version: Nevada's regulator has not opened the door to every kind of nicotine vending, so we are not placing machines here yet.
Afterwrk is not placing machines in Las Vegas yet. Nevada's Department of Taxation says a vending machine for other tobacco products is not permissible under current law. We are taking interest from Las Vegas venues that are 21+ at all times, and we will say plainly when that changes.
Under regulatory review — not placing Nevada: Cigarette vending has its own licence class; other tobacco products, which by statute include vapes and nicotine pouches, have none. Interest is welcome; placements are not.
The state rule comes first
Nevada draws a line between cigarettes and everything else. A cigarette vending machine has a licence class of its own — NRS 370.015 defines a cigarette vending machine operator as a retail dealer licensed to sell only Nevada stamped cigarettes by coin-operated machine — and NRS 202.2494(1) makes such a machine lawful in a public area only where people under 21 are barred from loitering under NRS 202.030 or NRS 463.350. There is no equivalent licence for other tobacco products, and the Department of Taxation states that operating an OTP vending machine “is not permissible under Nevada law when the activity is not specifically authorized by the Legislature”. Large properties are not one venue
A resort is a gaming floor, several restaurants, a pool, a theatre and a hotel, with different age rules in each. The federal restriction attaches to the facility where the machine sits, so the useful question is not “is this property 21+” but “where does the age-controlled area begin and end, and does it hold at 11am on a Tuesday as well as at midnight.”
- The exact boundary of the age-controlled area, and how it is enforced.
- Whether that boundary holds at every hour the property is open.
- Property policy, which can prohibit a placement the law would permit.
- The relevant gaming authority's position.
- Surveillance coverage, and access for servicing.

Common questions
Can a Las Vegas bar host a nicotine vending machine today?
It depends entirely on what the machine sells, and being a 21+ bar does not settle it. Nevada licenses cigarette vending and NRS 202.2494(1) allows such a machine where under-21s are barred from loitering. Everything else is an other tobacco product under NRS 370.440(2), including vapes and nicotine pouches, and there is no licence class for vending those. Afterwrk is not placing machines in Nevada until that is resolved.
Do Strip resorts qualify under the federal rule?
Only a specific area could, never a whole resort. A property with a gaming floor, restaurants, pools and hotel corridors has different age rules in each, and the federal test attaches to the facility where the machine sits.
