This agreement

These terms are between you and Afterwrk Vending Co. (“Afterwrk”, “we”), and they govern your use of this website. By using the site or submitting a venue assessment you accept them. If you do not, please do not use the site.

What this site is

This site describes a service and lets a venue operator ask to be assessed for it. That is all it does.

Submitting an assessment is not a contract and does not oblige either of us to anything. It is a request. We may decline it, and you may withdraw it. If we go ahead, the actual arrangement will be set out in a separate written agreement covering placement, servicing, revenue and term, and that agreement — not this site — will govern it.

Who may apply

You may submit a venue assessment only if all of the following are true:

• You are at least 21 years old.
• You are authorised to act for the venue you are describing.
• The venue restricts entry to guests 21 and over at all times.

Federal rules restrict tobacco-product vending machines to facilities where people under 21 are not present or permitted to enter at any time. State and local requirements may impose further restrictions or prohibit certain placements outright. Eligibility is decided case by case, and nothing on this site is a promise that a particular venue qualifies.

Accurate information

We rely on what you tell us to judge eligibility and to apply for licences. You agree that the information you submit is accurate and complete to the best of your knowledge, and that you will tell us if something material changes — particularly the venue's age policy, its licensing position or its address.

No sales through this site

Nothing is sold to consumers here. This site does not offer, advertise for sale, or take orders for nicotine products, and it is not directed at consumers. Products are dispensed only from machines inside eligible venues, to verified adults, at the point of sale.

Our content

The text, film, photography, design and marks on this site belong to Afterwrk or are used with permission. You may read, link to and share the site. You may not copy the film or the design for your own commercial use, or use our name or marks in a way that suggests we endorse you, without our written permission.

Third-party services

The venue assessment form is embedded from a third-party provider, and the site links elsewhere from time to time. Those services have their own terms and privacy practices, and we are not responsible for them. Read them before you rely on them.

Imagery on this site

Images and film on this site may be computer-generated, and may show venues where our machines are not installed. Where that is the case, what you are looking at is an illustration of the service rather than a record of a particular site. We do not label each image individually, so treat any of them as illustrative unless we have told you otherwise in writing.

We render rather than photograph because machines go into rooms that are closed to anyone under 21 and are not ours to shoot. As real installations are photographed, real photographs will replace rendered ones, and this section will continue to apply to whatever remains rendered.

So, whichever it is: the machine you receive may differ in dimensions, finish, screen, payment hardware and product layout from what is shown, and the products, prices and on-screen content depicted are illustrative. Placement in your venue is determined by the survey, by what your room allows and by what local rules permit — not by anything pictured here. Ask us for the current specification sheet before relying on any detail of it, and do not treat an image as evidence that a particular venue is a customer.

Disclaimers

The site is provided as it is. We work to keep it accurate and available, but we do not warrant that it will be uninterrupted, error-free, or that any description of timing, cost or eligibility will hold in your particular case.

Nothing on this site is legal advice. Tobacco and nicotine rules differ by state, county and city and they change. Do not treat anything here as a substitute for advice from your own counsel or from the relevant authority.

Liability

To the fullest extent the law allows, Afterwrk is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or lost business, arising out of your use of this site. Nothing here limits liability that cannot be limited by law.

Governing law

These terms are governed by the laws of the State of New Mexico, without regard to its conflict-of-laws rules. Any dispute arising out of them will be brought in the state or federal courts located in New Mexico, and we each consent to that venue.

Changes and contact

We may update these terms. The date at the top of the page shows when they last changed, and continuing to use the site after a change means you accept it.
