Does Your Venue Qualify for a Nicotine Vending Machine?
One question decides most of it: is anyone under 21 ever permitted inside?
If people under 21 are ever permitted inside your venue — at any hour, for any reason — it will not qualify under the current model. If the premises is 21+ at all times, with controlled entry, it is worth a compliance review.
The rules behind the answer
- Federal: tobacco products may not be sold from a vending machine in a facility where people under 21 are present or permitted to enter at any time.
- New Mexico: tobacco-product vending is allowed in age-controlled locations where minors are not permitted, with licensing, signage and verification requirements attached.
- Arizona: tobacco vending machines are limited by statute to bars and closed employee lounges.
- Nevada: cigarette vending has a licence class and other tobacco products — which by statute includes vapes and nicotine pouches — do not, so we are not placing there.
- Local rules vary by state — Arizona expressly allows local government to restrict further, New Mexico requires consistency with its Act — and are checked before any placement is confirmed.

What disqualifies a venue fastest?
Admitting under-21 guests at any time. Federal rules restrict tobacco-product vending to facilities where people under 21 are not present or permitted to enter at any time, so a venue with any under-21 access does not fit the current model.
What about staff under 21?
It needs manual review. The federal language concerns individuals under 21 being present or permitted to enter, which is why an under-21 employee is not something we will wave through on a form.
Is a result from the checker an approval?
