Nicotine Vending Machine Laws by State

We add a state only when we have read the primary source ourselves. Three so far.

Short answer

Federal rules allow tobacco-product vending only in facilities where nobody under 21 is present or permitted to enter. Each state then adds its own conditions. New Mexico limits vending to age-controlled locations, Arizona limits it to bars, and Nevada authorises cigarette vending only, with vapes and nicotine pouches falling on the other side of that line by statute.

StateWhat the source saysSource
FederalNo tobacco-product vending in any facility where people under 21 are present or permitted to enter at any time.FDA retail rules
New MexicoTobacco products may be sold by vending machine only in age-controlled locations where minors are not permitted. Licensing and signage apply.NMSA 61-37-15
ArizonaOnly in a bar, or in a non-public employee lounge of a business that employs no minors. An eighty-square-inch warning sign is required. Local governments may restrict further.A.R.S. 36-798.02
NevadaCigarette vending has its own licence class, confined by NRS 370.015 to “only Nevada stamped cigarettes”, and NRS 202.2494(1) permits such a machine in a public area only where under-21s are barred from loitering. Everything that is not a cigarette is an other tobacco product under NRS 370.440(2), which names vapor products and alternative nicotine products expressly; there is no OTP vending licence class and the Department of Taxation says the activity is therefore not permissible. NRS 202.2494(2) separately bars a machine containing cigarettes from dispensing anything not made or derived from tobacco.NRS 202.2494, NRS 370, Dept. of Taxation FAQ

Common questions

Why only three states?

Because we only list a state once we have read its primary source. A longer table built from other people's summaries would be less useful than a short one you can check.

Does state law override the federal rule?

No. The federal rule is the floor everywhere: no tobacco-product vending in a facility where people under 21 are present or permitted to enter at any time. States can only add to it.
