What to Ask Before You Sign a Nicotine Vending Agreement
Put these to any operator, including us. A good one answers all of them in writing.
Before you sign, get written answers on five things: what your share is a percentage of and when it is paid; who owns the machine and the stock; who holds the tobacco license and carries the age-verification duty; who fixes and restocks the machine and how fast; and how either side can end the arrangement, including who removes the machine and repairs the wall.
The money
- What is my percentage, and what exactly is it a percentage of — gross sales, sales after tax, or sales after product cost?
- When am I paid, by what method, and what sales report comes with each payment?
- Are there any fees, minimums or charges to the venue, now or later?
- If someone quotes a typical monthly figure: how many machines is that based on, over what period, and in what kind of venue?
Ownership and risk
- Who owns the machine, and who owns the stock inside it?
- If the machine is damaged or broken into, whose loss is that?
- Is the operator insured, and can I see a certificate?
Licensing and compliance
- Who holds the tobacco retail license for the placement — me or the operator?
- What does hosting do to my liquor license conditions, and who have you checked that with?
- How is age checked at the machine, on every sale, and what record is kept?
- What happens if an inspector finds a problem with the machine?
Servicing
- Who restocks it, how often, and how do they know it is running low?
- If it breaks on a Friday night, who do I call and how quickly do they come?
Ending it
- How long is the term, how can either side end it, who removes the machine, and who repairs the wall?
How Afterwrk answers them
We own the machine and the stock, we restock and service it, we process the payments, and there is no equipment, stock or servicing cost to the venue. The share, the payout schedule, the term and the exit are set out in the venue agreement before anything is installed. How our revenue share works →

Common questions
Is it normal to negotiate these terms?
Yes. The percentage, the payout timing, the term and the exit are contract terms, and they are what a venue should be negotiating.
