New Mexico Nicotine Vending Machine Laws

Short answer
New Mexico's Tobacco Products Act contemplates tobacco-product vending in age-controlled locations where minors are not permitted, and attaches tobacco retail licensing, required signage at the vending location and age and identity verification obligations. Federal rules apply on top and local rules may be stricter.

What trips venues up
- Reading “age-controlled” as “we card at night”. It means minors are not permitted, full stop.
- Assuming a liquor licence covers tobacco. It does not.
- Assuming the operator's licence covers the venue, or the reverse. Which party holds what is a term of the agreement, and it should be written down.
- Treating state law as the ceiling. A city can be stricter.
