Hotel Bars and the Adjacency Problem

The bar is not the facility. That distinction decides most hotel placements.

Short answer

The federal exception turns on the facility where the machine is located and who is permitted to enter it at any time. A hotel bar that opens onto a lobby, shares a corridor with lifts and guest rooms, or serves breakfast is part of a space guests of any age pass through. A bar that is a separately enclosed room with its own controlled entrance is a different proposition. Where the boundary falls is the whole question.

Why hotels are harder than standalone bars

A standalone bar has one door and a door policy. A hotel has a lobby, lifts, corridors, meeting rooms, a restaurant, a pool and guest rooms, and the bar is usually open to several of them. The federal wording asks about the facility where the machine sits, so the answer depends on how separable the bar actually is — not on how strictly it cards when someone orders a drink.

What makes a hotel bar a candidate

Where all five hold, the analysis looks like any other 21+ bar. Where any one fails, it needs a considered answer.

The usual failure modes

The lobby barOpen to the lobby by design. The lobby is not age-controlled, so the facility is not.
Breakfast serviceThe same room serving all ages in the morning defeats 'at any time'.
The through-routeGuests crossing the bar to reach lifts or restrooms are permitted to enter it.
Function and event spaceA room that hosts a wedding or a corporate event with under-21 attendees.
Under-21 staffA separate question again, and one that needs review rather than a form answer.

Who has to approve it, beyond the law

Hotels add an approval chain that standalone venues do not: the general manager, brand standards if the property is flagged, facilities for anything fixed to a wall, and the owner or management company. A placement that is legally fine can still be declined on brand grounds, and it is better to find that out early.

How Afterwrk approaches it

We treat a hotel bar as its own review rather than as a bar that happens to be in a hotel, and the first question is where the facility boundary falls. If the honest answer is that the bar is part of a mixed-age space, we will say so — that is a no, and it is better delivered before anyone has spoken to brand standards.

Common questions

Our hotel bar is 21+ after 6pm. Does that work?

No. The test is who is permitted to enter at any time, so an all-ages daytime use defeats it.

What if the bar has its own street entrance?

That helps considerably, provided it is genuinely separable and nobody under 21 passes through it.

Is this the same issue as a restaurant with a bar area?

Yes, in substance. The question is whether the machine sits in a facility that excludes under-21s at all times.
