Are Nicotine Vending Machines Legal in New Mexico?

Short version: yes, in age-controlled locations where minors are not permitted — and that qualifier does most of the work.

Why venue owners care about this specific question

Because the honest answer is not “yes” or “no” — it is “yes, if your door policy is what you think it is.” Most venues that assume they qualify fail on one detail: they are 21+ in the evening and open to everyone earlier.

The two layers

• Federal. Tobacco products may not be sold from a vending machine in a facility where people under 21 are present or permitted to enter at any time. This is the floor and no state can lower it.
• New Mexico. The Tobacco Products Act contemplates vending in age-controlled locations where minors are not permitted, and attaches licensing, signage and age-verification requirements.
• Local. City and county rules may be stricter than the state's, and are checked per address.

The decision checklist

• Is anyone under 21 permitted inside at any hour, on any day, for any reason?
• Is entry controlled, with identification actually checked?
• Does the venue hold — or can it host — the required tobacco retail licensing for the address?
• Is the required signage in place at the vending location?
• Is there a verification process at the point of sale as well as at the door?

What this does not tell you

Whether your venue qualifies. Statutes are general; licensing is per address. A venue two doors down may sit under a different local rule. Treat this as the shape of the question rather than the answer.
